ENS (Edward Nathan Sonnenbergs) has extensive experience in South Africa’s dynamic and challenging medical scheme sector and with our specific sector knowledge and the legal issues affecting it, we are ideally placed to assist clients in this area.  We have played a vital role in advising some of the largest medical schemes in South Africa and give advice primarily on two levels:

  • Regulatory issues, including compliance with the Medical Schemes Act 131of 1998, the relationship between medical schemes administrators and brokers as well as capital adequacy requirements.
  • Employee benefit scheme issues, including advising employers and scheme trustees on various legal issues relating to, for example, changes to scheme membership and changes to scheme benefits and their employment law implications.

The Medical Schemes Act (131 of 1998) mentioned above was established to provide regulatory supervision of private health financing through medical schemes and the Council for Medical Schemes is an autonomous statutory body created by parliament to regulate Medical Schemes in South Africa.
