At ENS (Edward Nathan Sonnenbergs) we have developed longstanding partnerships with South Africa’s top retailers. Our experience in general retail, clothing, foods, hospitality and pharmaceutical retail is unsurpassed and we have assisted leading clients with their expansion into international markets and the restructuring of their businesses to take advantage of outsourcing, e-commerce and new industry regulation. The retail sector’s performance often reflects consumer confidence and in an economic downturn such as has been experienced globally, many retailers have felt the effects and need expert legal advice on restructuring or business rescue. In addition, the Consumer Protection Act 68 of 2008 (“the Act”) was signed into law on 24 April and gazetted on 29 April 2009 and will come into full force and effect 18 months after promulgation, namely on 29 October 2010, as per the transitional provisions. This Act will have far-reaching consequences in the area of product liability, especially on the right to fair value, good quality and safety. There are important aspects for manufacturers, suppliers and retailers to note and all businesses forming part of the retail chain are encouraged to make the most of the following 15 months, before the Act is in full force and effect, and to align their trading practices for the purposes of complying with the Act. With all these considerations, it is vital to have the right legal partner.
ENS offers effective risk management advice and as the largest full-service law firm in Africa, we are able to offer the most cost-effective all-round solutions to any of our retail clients needs, including corporate restructuring, mergers and acquisitions, franchising, distribution schemes, employment contracts transfers, retrenchments, E-commerce and licensing and intellectual property.
