fishing and marine resourcesThe fishing and marine resources team at ENS (Edward Nathan Sonnenbergs) consists of a number of professionals with diverse experience under the broad umbrella of fishing and marine resources law. Members of our team were instrumental in the drafting of South Africa’s Marine Living Resources Act (MLRA) and Regulations and served on the erstwhile Fisheries Transformation Council. The MLRA, Reconstruction and Development Programme and our Constitution are all premised on the need for transformation and in the fishing industry this applies to the extent in which transformation processes should be allowed to disturb the structure of existing interests. Globalisation and home-grown structural adjustment policies all add to the challenge of large-scale redistribution in the sector and having a highly experienced and specialised advisory team, such as is found at ENS, is vital. ENS has advised and continues to advise members of the private sector as well as organs of state in relation to fishing resource management across a variety of different fisheries, taking into account the peculiar history, challenges and circumstances of the South African fishing industry and enforcement mechanisms in relation to the MLRA. We also advise in Black economic empowerment transactions and imperatives, to realise the aspirations of Government and participants in the fishing industry as well as advise and draft stakeholder submissions on the policies for the allocation of long term fishing rights. Our fishing and marine resources team works closely with, amongst others, the commercial and maritime teams, to facilitate comprehensive and creative solutions. With our extensive all-round experience in this highly specialised field, we are able to offer our clients cost-effective, timely solutions to any of their fishing and marine resource needs.
